    Seeking UK Asylum from Albania

The number of Albanian nationals who attempted to claim asylum in the UK rose in 2022 compared to previous years.

According to government figures, 16,000 Albanian citizens applied for asylum in the UK in 2022, accounting for 16% of all asylum applicants of that year. Of this number, 12,301 Albanian citizens arrived by small boats across the English Channel – more than a quarter of those arriving in small boats were Albanian that year.

The UK government states Albania is a “safe” country that has European Union candidate status and has strong relations with the Albanian government, yet in 2022 48% of Albanian asylum claims from small boat crossings or other means were successful.

The Home Office does not officially acknowledge reasons for the successful asylum applications. However, it has been suggested that applications from Albanian applicants might be granted on the basis that they have been trafficked, especially if they are a female trafficking victim and victims of modern slavery.

This can be supported by the fact that Albanian women made up 88% of successful Albanian asylum claims.

Eligibility Requirements for Seeking Asylum from Albania in the UK

Albanian citizens can receive a successful asylum claim in the UK if they can prove they have a genuine asylum claim registered in the asylum system.

People from Albania are eligible to seek asylum in the UK if they can prove that they fear persecution due to their race, religion, political opinion, nationality, sexual preference, or other issue that puts them at risk because of the social, cultural, religious or political circumstances there.

A mid-year 2023 report by the Home Affairs Committee states that there are ‘unquestionably’ cases of Albanian nationals who are being trafficked. The UK must support trafficking victims and ensure their safety, so this could be the reason behind the 88% successful asylum grant rates in 2022.

Apart from human trafficking, it has been reported that Albania also has other long-standing issues such as discrimination and violence against the LGBTQ+ community, Albanian criminal gangs, corruption, discrimination against communities of ethnic Roma and Egyptian, and sexual/domestic violence.

Those who are not Albanian victims, victims of modern slavery or other forms of persecution, are less likely to be initially accepted as successful asylum applicants. Any unsuccessful applicants or foreign national offenders will be asked to leave the UK.

It is important to establish whether you would be successful for asylum before you apply, to gather the necessary evidence and documents. Get help from London Immigration Lawyers by calling 020 4502 8582 to maximise your chances of a successful claim.

Required Documents for an Asylum Application in the UK for Albanian Citizens

For asylum applicants in the UK, you will need the following supporting documents:

    • Passport or any other travel documents
    • Proof of identity such as birth certificate or ID card. These should be translated into English.
    • Any other document or pieces of evidence that may confirm the genuineness of your claim for asylum

If you are already in the UK at the date of application, you will need to submit a UK address and proof of this address using the following documents:

    • Bank statement
    • Tenancy agreement
    • Housing benefit book
    • Council tax notice
    • Utility bills

If you are living in the UK with a friend, family member or someone else, you will need to provide one of the following:

    • Letter, dated within the previous three months, from the person you’re staying with, confirming you have permission to stay.
    • Document with the full name and address of the person you’re staying with, such as a tenancy agreement, council tax notice or utility bills

Registering Your Claim in the UK

Albanian citizens who want to claim asylum in the UK are required to discuss their situation with a UK immigration officer first before an application is made. This meeting is called a ‘screening’ and you will register your claim during this.

The screening might occur at your port of entry if you claim asylum as soon as you arrive in the UK. However, you may also be screened after arriving in the UK.

    During a screening, you will:

    • Have your photograph and fingerprints taken
    • Attend an interview where you will discuss who you are and where you are from
    • Be asked why you wish to claim asylum in the UK

You should bring supporting documentary evidence for your claim and other required documents to the screening. You must also declare any medical condition you or any of your dependent family members have.

To claim asylum upon entry, you need to inform the UK Border Force officers that this is what you want to do.

If you are already in the UK, you must contact the asylum intake unit to make an appointment for a claim.

What Happens After the Registration of Your Asylum Claim in the UK?

After the initial screening process, the Home Office will review your case and decide if it can be considered in the UK.

You will get an asylum registration card (ARC) and possibly a questionnaire to understand your case in more detail.

If the Home Office decides that your asylum case could be considered for an application in the UK, you will be assigned a caseworker. They will interview you and decide if your asylum application should be accepted or not.

You are entitled to help with living in the UK, as well as legal representation for your claim.

It is extremely important only to include the correct information and details in your asylum application. If you include any false information, you could face up to 2 years in prison or have to leave the UK.

If your claim is successful, you will be released from this centre, however, if your claim is unsuccessful, you will be ordered to leave the UK or removed.

Failed asylum seekers could be detained at an immigration detention centre until they are removed from the country.

      UK Asylum Application Processing Time

Once you have claimed asylum, you will need to wait until the Home Office declares if your claim was approved. In 2020, most claims for asylum seekers were cleared in under 6 months; however, this increased to 20 months in 2021.

It is most likely that your claim could take anywhere between 1 and 3 years to be complete. If your case or evidence needs further investigation or verification, it could take longer for Albanian asylum applicants.

If your claim is successful, you may be granted refugee status in the UK. The Home Office then permits you to stay in the UK for a minimum of 5 years.

After 5 years of living in the UK, you can apply to settle in the UK, subject to other conditions.

When Your Claim from Albania Might Not Be Considered

If your claim is purely for economic reasons, including improved job prospects or higher incomes, your application will most likely be rejected. Economic migrants are not largely given asylum in the UK.

To be granted asylum as Albanian citizens, you must have a genuine reason, such as fleeing from persecution or discrimination.

      Albanian Asylum Application Appeal

If your application is rejected, the Home Office will have to write to you explaining the reasons for rejection.

There is a right of appeal to the Tribunals Service within a limited time. It is generally possible to submit an appeal within two weeks. The appeal is considered by a separate immigration judge who is not related to the Home Office.

Whether you or the Home Office will have the chance to make a further appeal against the Judge’s decision depends on the individual matters of the particular case.
