    What Is the Overseas Domestic Worker Visa?

    Whether you are a worker seeking private household employment in the UK or a UK resident seeking to bring foreign domestic workers overseas for work, the Overseas Domestic Worker Visa is the best route to take.

    A foreign national can use this visa to visit the UK and work for their employer for up to 6 months. Following this period, the worker will not be able to extend the visa. Instead, they must return home. To continue employment under this visa, the worker must reapply from their country of origin.

    You will be able to travel outside the UK for the duration of your visa, and you are permitted to change employers while under the visa – so long as you do not extend your stay past the original 6-month period.

    Under this visa, you are not permitted to take on any employment other than domestic work. You will also not be allowed to access public funds under this visa type.

    Who Is Eligible for the Overseas Domestic Worker Visa?

    You must meet specific requirements to apply for the Domestic Worker Visa. To help you determine whether you qualify, below are the eligibility criteria:

    • You must reside in a country outside the UK.
    • You must be a domestic worker (e.g. cleaners, chauffeurs cooks) for a private household.
    • You must have been in employment with this employer for at least 1 year.
    • You must work in private households occupied by your employer (a house in which they live part or full-time).
    • You must enter the country with your employer or their family member.
    • You must plan to leave the UK after the 6 month visa period.
    • You must be able to support yourself financially without government aid.
    • Your employer must be a UK citizen who does not intend to stay in the UK for longer than 6 months and has an alternate residence in another country.
    • Your employer must be a foreign national who has a visa to stay in the UK and does not intend to stay in the UK for longer than 6 months.

    An employer is obliged to pay at least the national minimum wage while you are working in the UK. Your employment contracts should show that you do not intend to work excessive hours for your employer, as this would contravene UK employment rights.

    What Is the Application Process for the Overseas Domestic Worker Visa?

    To apply for an Overseas Domestic Worker Visa, you must apply from outside the UK. To begin the application process, you must visit the UK Home Office online portal, which will allow you to complete an online application.

    You must also travel to a visa application centre to have your biometric identification details taken. Your biometric details will include fingerprint information and facial profile identity information.

    You must submit your application at least 3 months before your intended travel date. Your employer will be responsible for covering the cost of your visa and travel expenses and they will not be permitted to draw these costs from your salary.

    What Documents Do I Need for the Overseas Domestic Worker Visa?

    When applying for the Overseas Domestic Worker Visa, you must provide proof that you and your employer meet the eligibility criteria. To do this, you must provide the following documents in your Domestic Worker Visa application:

    • Valid travel identification, such as a valid passport.
    • Evidence of financial capacities, such as bank statements showing payment.
    • Appendix domestic worker statement, signed by both you and your overseas employer.
    • A letter from your employer including your job title, employment term, and confirmation of your employment on a permanent basis.
    • One of the documents covering your employment period:
      • Pay slips/bank statements providing salary confirmation for minimum wage
      • Tax paid confirmation
      • Health insurance paid confirmation
      • Contract of employment
      • Proof of residence in the country where you work for your employer, such as a residence permit, passport, or worker visa.
      • Visas or passport endorsement from previous travel with your employer.

      How Long Is the Processing Time for the Overseas Domestic Worker Visa?

      Once you have submitted your application for the Overseas Domestic Worker Visa, you can expect to wait up to 3 weeks to receive approval for your visa application. Should your visa application be refused, you can submit an appeal to the First-Tier Tribunal with the Immigration and Asylum Chamber. Once you have submitted your appeal, you can expect to hear back from the tribunal within 28 days of submission.

      If you need your visa sooner than 3 weeks, you can opt to pay for fast-track services. Your employer should cover this expense. The fast-track visa fee is £500 and means you will be able to receive your visa decision within 5 working days.

      There is also a superior priority service that costs £800 and provides a decision within one working day.

      How Much Does the Overseas Domestic Worker Visa Cost?

      The cost of the Overseas Domestic Worker Visa fee is £531. Of course, if you opt for a priority or super priority visa fast-track, your employer will need to cover these costs on top of the original visa fee.

      How Do I Renew My Overseas Domestic Worker Visa from the UK?

      You will only be eligible to apply for renewal of the Domestic Worker Visa from inside the UK if you applied for your original visa before 5 April 2012. At this time, the Overseas Domestic Worker Visa was called the Domestic Worker in a Private Household visa.

      A successful application will allow you to add extended periods of 12 months to your visa. To be eligible to extend your stay in the UK under the visa for domestic workers, the following must apply:

      • You must be a full-time domestic worker (e.g. family nanny) in a private household
      • You must meet the UK national minimum wage regulations
      • You must have applied for your original visa before 5 April 2012
      • You must have continuously lived in the UK
      • You must apply from within the UK
      • Your employer must provide proof of their intent to continue your employment
      • You and your employer must provide a signed appendix domestic worker statement.

      To apply for an extension of your visa, you must visit the Gov.uk website and follow the application instructions. You are permitted to extend the work visa for your children aged 18 and under, along with your spouse.

      The cost of 12-month extended periods for the visa is £1,048.

      Language Requirements for the Overseas Domestic Worker Visa

      To enter the UK under the Overseas Domestic Worker Visa, you must meet English language requirements. To evidence your understanding and knowledge of the English language you must pass a CEFR level B1 test for speaking, writing, reading, and listening. If you have an academic qualification taught in English and recognised by the Ecctis board, you will not need to pass this test.

        Exceptions for the Overseas Domestic Worker Visa

        There are some exceptions when it comes to the Overseas Domestic Worker Visa. If you’re a victim of human trafficking or modern slavery while under the domestic staff visa, you can access residency in the UK for 2 years. To access this residence permit, you must provide the following documents evidencing that you meet certain eligibility criteria:

        • A conclusive grounds letter from the Single Competent Authority (SCA).
        • Evidence that you entered the UK with a British national under a UK Domestic Worker Visa.

        Once you receive your letter from the SCA, you should apply for your UK visa within 28 days of receipt. This visa type is free, and you can apply online.
