Can I Change my Visitor Visa to a Work Permit in UK?
If you are in the UK on a Visitor visa and considering staying long-term, it’s essential to understand what options are available to you under the UK Immigration Rules.
Contact an IAS lawyer at 0204 502 8582 for more information on switching from a UK Visitor visa and expert assistance with your immigration situation.
Can I Change a Visitor Visa to a Work Permit in the UK?
Unfortunately, you cannot switch from a UK Visitor visa to a work permit while in the UK. The UK Immigration Rules require you to leave the country and apply for a work visa from your home country or another eligible location.
This is because the UK Visitor visas, which include the Standard Visitor visa and the Marriage Visitor visa, are intended for temporary stays and are not pathways to long-term residence.
When applying for a Visitor visa, you must prove that you will leave the UK at the end of your visit. You are also prohibited from undertaking paid or unpaid work in the country.
The UK government is strict against any attempts to misuse short-term visas for purposes beyond their intended use and as a means to work or secure a long-term stay in the country.
Attempting to remain in the UK and switch from a Visitor visa to a Work permit will result in a visa rejection. Since this violates the terms of your visitor permit, it could also lead to future travel restrictions.
How to Switch if I Got a Job Offer Whilst Visiting the UK
Overview
If you are in the UK on a Visitor visa and receive a job offer, the standard procedure is to return to your home country and apply for the appropriate work permit. You must submit a new application since you cannot legally switch to a work visa.
Follow these steps to secure your work visa after receiving a job offer as a visitor in the UK:
Leave the UK
You must leave the UK before your Visitor visa expires. Overstaying, even for a short period, violates the UK’s immigration rules and can have serious consequences, including negatively impacting your work visa application.
Confirm Your Eligibility
Check that the job offer meets the specific requirements for the UK work visa you plan to apply for. For instance, if you receive an offer for a role on the list of eligible skilled occupations, it must meet the salary thresholds, employer sponsorship, and language requirements for the Skilled Worker visa category.
Gather Your Supporting Document
Prepare all necessary documents for your work visa application, including:
- A valid passport or travel document.
- Passport photographs
- Evidence of your qualifications and work experience.
- Proof of English language proficiency.
Depending on the visa type you are applying for, you may also be required to provide:
- A Certificate of Sponsorship (CoS) from your employer
- Details of your job role with proof that it meets the financial requirement
- A criminal record certificate
- A tuberculosis test result if you are from a country that must produce one.
- Bank statements.
Apply for a Work Visa
Once you have gathered all the necessary documents, visit the UK Visas and Immigration (UKVI) website to apply for your work visa. You must provide all the requested information, including personal and job information. You should also upload scanned copies of your supporting documents to the online service and pay the required visa fees.
Depending on your situation, you may also need to book and attend a biometric appointment at a UK visa application centre in your country of residence.
Await a Decision
Processing times for UK work visas vary, but most work visa applications from outside the UK are typically decided within 3 weeks. If you want a faster decision on your application, you may be able to utilise the priority or super-priority services for an extra fee. With these services, you can receive a decision within a few days.
Return to the UK
If the UKVI approves your application, you will receive a visa vignette in your passport, allowing you to re-enter the UK and begin your new job. The vignette, which the government plans to phase out soon, will be valid for 90 days, after which you must apply for an eVisa.

Switching from Visitor Visa to Other UK Visa Routes
While you cannot change your visa status from a visitor to a work permit in the UK, you may be able to switch to a Family visa based on private life. However, this switch may only be possible if exceptional family circumstances require you to remain in the UK.
For instance, if you are the parent of a British child or a child who has lived in the UK for 7 years and, it will be unfair for your child to leave the UK.
Similarly, you may also be able to remain in the UK if you are granted Leave Outside the Rules (LOTR) based on compelling humanitarian or compassionate grounds that prevent you from returning to your home country at the end of your visit. For instance, if there is an emergency, a natural disaster, a threat to your life, or in cases of medical or modern slavery.
Note that LOTR is typically granted for a specific period that will allow you to overcome the compassionate or compelling grounds you raised. In most cases, the validity period will not be longer than 30 months. Afterwards, you might need to leave the country.
Furthermore, if you do not have compelling or exceptional reasons to remain in the UK, you may be able to extend your Visitor visa for longer than the standard 6-month duration. However, visit visa extensions are only possible under the following circumstances:
- You need to continue receiving medical treatment in the UK
- You are visiting as an academic, still meet the eligibility requirements, and are not filling a permanent teaching post.
- You are a graduate retaking the Professional and Linguistic Assessment Board (PLAB) test or doing a clinical attachment.
Switching from a Visitor to a Family visa or applying for leave to remain under compassionate grounds are both complex immigration proceedings. You should consult with a UK immigration lawyer to determine the best route for your situation. Call 0204 502 8582 to discuss your situation.
